Questo lavoro si propone di indagare il complesso iter che ha portato nel 1978 all’introduzione nell’ordinamento italiano della brevettabilità dei medicamenti. Elemento comune di tutto il secondo dopoguerra è il continuo intrecciarsi del piano giurisprudenziale e di quello legislativo e la difficoltà del legislatore di giungere ad una sintesi condivisa. Per ricercare le motivazioni di questa difficoltà il saggio indaga l’evoluzione delle posizioni delle associazioni di categoria e i nodi ideologici che influenzano le posizioni dei maggiori partiti dell’arco costituzionale. Un’analisi dei cambiamenti intervenuti nel dopoguerra nella struttura del settore mostra come la vicenda della tutela brevettale dei medicamenti, centrale nel dibattito delle associazioni di categoria, in realtà non possa essere considerata la causa prima dei fenomeni di concentrazione aziendale in corso.

In his essay, the Author reconstructs the complex passage into Italian legislation of a bill on the patentability of drugs, which became law only in 1978. A constant characteristic of the post WWII period was indeed the close intertwining – on the subject – of legislative and jurisprudential fields; as a consequence, it was difficult for the legislator to come to a convincing synthesis of the two viewpoints. In order to get to the root of this involved situation, the Author takes into consideration the changes in the attitude of the trade associations and the ideological questions which influenced the choices of the major parties in Italian Parliament. An analysis of the post-war changes in the structure of Italian pharmaceutical sector shows how patent protection of drugs – a central issue in the debate within trade associations – actually cannot be considered the cause of the ongoing process of industrial concentration.
